Eye Friend Terms and Conditions

DeFiCall – A Global Super App


1. Introduction

These Eye Friend Terms and Conditions (“Eye Friend Terms”) govern your access to and use of the Eye Friend feature within DeFiCall.

Eye Friend is a privacy-focused, permission-based location-sharing and safety feature that enables users to share location information with people they choose and authorize.

These Eye Friend Terms supplement the DeFiCall General Terms and Conditions and should be read together with:

  • the DeFiCall General Terms and Conditions;

  • the DeFiCall General Privacy Policy; and

  • the Eye Friend Privacy Policy.

By enabling, accessing, or using Eye Friend, you agree to these Eye Friend Terms.


2. Purpose of Eye Friend

Eye Friend is designed to enable permission-based location sharing between DeFiCall users.

Depending on the functionality available, Eye Friend may allow users to:

  • share their current location;

  • share live or continuously updated location;

  • authorize selected persons to view their location;

  • view another user's location when properly authorized;

  • manage location-sharing relationships;

  • use location-based safety functionality;

  • receive applicable location-related notifications; and

  • discontinue or revoke location sharing.

Eye Friend is intended to provide users with greater control over how they share their location with people they trust.


3. User Consent and Control

Eye Friend operates on the principle of user-controlled location sharing.

Users decide whether to activate the feature and whom to authorize.

A user is responsible for:

  • intentionally enabling location sharing;

  • selecting trusted persons;

  • granting required device permissions;

  • reviewing authorized connections;

  • revoking access when appropriate; and

  • using Eye Friend only for lawful purposes.

Merely having a DeFiCall account does not automatically authorize another user to view your Eye Friend location.


4. Authorization Required

A person may access another user's Eye Friend location only through the applicable authorization mechanism provided by DeFiCall.

Depending on the available functionality, authorization may involve:

  • adding or approving another user;

  • accepting a connection;

  • granting location access;

  • enabling location sharing for a selected person; or

  • another explicit authorization process.

Users must not attempt to access another person's location without appropriate authorization.


5. Encrypted Location Information

Eye Friend location information is protected through encryption.

Under the applicable Eye Friend architecture, DeFiCall servers do not receive or store users' location information in readable plaintext form.

Location information transmitted or stored through the applicable server infrastructure is maintained in encrypted form.

Accordingly:

  • location information is protected through encryption;

  • the server does not receive readable plaintext location;

  • ordinary DeFiCall users cannot access another user's location without authorization;

  • location information is not intended to be publicly available; and

  • access to readable location information is restricted through the applicable authorization mechanism.

Users acknowledge that encryption significantly improves confidentiality but no digital technology can guarantee absolute security against every possible threat.


6. Location Permissions

Eye Friend requires applicable device location permissions to provide location-based functionality.

Depending on the feature, device, and operating system, users may be asked to permit:

  • approximate location;

  • precise location; and/or

  • background location where required for enabled functionality.

Users may generally grant, deny, or withdraw permissions through their device settings.

If required permissions are denied, restricted, or withdrawn, some or all Eye Friend functionality may become unavailable.


7. Background Location

Certain Eye Friend functions may require location access while DeFiCall is not actively visible on the user's screen.

For example, continuous live-location sharing may require background location access so that an authorized person can continue receiving permitted location updates.

Where such access is required:

  • appropriate permission will be requested;

  • users will be informed of its purpose;

  • access will be used for the applicable location-based functionality; and

  • users may withdraw the permission through their device settings.

Disabling background location may interrupt or prevent continuous location sharing.


8. Authorized Recipients

Users should authorize location access only for people they know and trust.

An authorized recipient may, depending on the functionality and permission provided, be able to view:

  • current location;

  • live location;

  • location updates;

  • applicable timestamps; and

  • other information necessary to provide the authorized Eye Friend functionality.

DeFiCall does not independently choose whom a user should authorize.

The decision remains with the user.


9. Responsibility of Authorized Recipients

Authorization to view another person's location is provided for the purposes permitted by that user and the Eye Friend functionality.

Authorized recipients must use location information responsibly and lawfully.

Authorization does not give a recipient unrestricted rights to:

  • publish another person's location;

  • commercially exploit it;

  • use it for stalking;

  • use it for harassment;

  • conduct unlawful surveillance;

  • threaten or intimidate the person;

  • sell the information; or

  • otherwise misuse it.

Recipients are responsible for their own conduct after receiving authorized access.


10. Revoking Access

Users may revoke another person's Eye Friend authorization through the available controls.

Once authorization has been revoked, the removed person should no longer receive future location information through that authorization.

However, revocation cannot necessarily remove information that the recipient previously:

  • viewed;

  • remembered;

  • captured through a screenshot;

  • recorded;

  • independently stored; or

  • communicated outside DeFiCall.

Users should therefore carefully consider whom they authorize.


11. Location Accuracy

Eye Friend relies on device-generated location and related technologies.

Location accuracy may be affected by:

  • GPS availability;

  • device capabilities;

  • physical surroundings;

  • internet connectivity;

  • mobile network conditions;

  • device sensors;

  • approximate or precise location settings;

  • operating-system limitations;

  • battery-saving settings; and

  • other technical or environmental conditions.

Accordingly, DeFiCall does not guarantee that Eye Friend location information will always be completely accurate, current, or continuously available.


12. Live Location Does Not Guarantee Real-Time Accuracy

The term “live location” describes functionality designed to provide updated location information.

It does not guarantee instantaneous or perfectly continuous location updates.

Updates may be delayed because of:

  • network latency;

  • GPS limitations;

  • device settings;

  • background restrictions;

  • battery optimization;

  • connectivity problems; or

  • other technical circumstances.

Users should consider this limitation when relying on location information.


13. Location Does Not Confirm a Person's Condition

Eye Friend provides device-generated location information.

A displayed location does not necessarily confirm:

  • the physical condition of the user;

  • whether the user is safe;

  • whether the device is physically with the user;

  • whether the user requires assistance;

  • the user's intended destination; or

  • the circumstances surrounding the user.

Users should not draw unsupported conclusions solely from location information.


14. Network and Device Dependencies

Eye Friend functionality may depend on:

  • internet connectivity;

  • mobile or Wi-Fi networks;

  • GPS;

  • device hardware;

  • operating-system services;

  • application permissions;

  • background execution;

  • battery availability;

  • notifications; and

  • other technical infrastructure.

Eye Friend may therefore become delayed, interrupted, inaccurate, or unavailable because of circumstances outside DeFiCall's reasonable control.


15. Eye Friend Is Not an Emergency Response Service

Eye Friend may support personal safety and location sharing, but Eye Friend is not an official emergency response service.

DeFiCall is not a:

  • police department;

  • ambulance service;

  • fire service;

  • emergency dispatch center;

  • rescue organization;

  • hospital; or

  • government emergency authority.

Eye Friend should not be treated as a replacement for professional emergency services.

Where immediate professional assistance is required, users should contact the appropriate official emergency authority available in their location whenever possible.


16. Prohibition on Unauthorized Tracking

Eye Friend must never be used to secretly, deceptively, unlawfully, or abusively track another person.

Users must not:

  • bypass authorization controls;

  • obtain location access through deception;

  • track another person without required authorization;

  • use another person's account to obtain location information;

  • circumvent privacy or security mechanisms;

  • secretly monitor another person;

  • use location information for stalking; or

  • otherwise violate another person's privacy or legal rights.

Unauthorized tracking may result in restriction, suspension, or termination of access and may also violate applicable law.


17. Stalking, Harassment and Surveillance

Eye Friend must not be used for:

  • stalking;

  • harassment;

  • intimidation;

  • coercive control;

  • threats;

  • unlawful surveillance;

  • exploitation;

  • discrimination;

  • blackmail; or

  • other abusive conduct.

Users who believe Eye Friend is being misused against them should revoke applicable authorization where possible and may report suspected abuse through available DeFiCall reporting or support channels.


18. No Sale or Commercial Exploitation of Private Location

Users must not sell, trade, commercially distribute, or unlawfully exploit another user's private Eye Friend location information.

DeFiCall itself does not sell Eye Friend location information as a commodity to third parties.

Additional privacy protections concerning location information are described in the Eye Friend Privacy Policy.


19. Account and Device Security

Users are responsible for maintaining appropriate security over their:

  • DeFiCall account;

  • device;

  • password;

  • PIN;

  • verification codes;

  • authentication credentials; and

  • authorized location-sharing connections.

Users should not knowingly permit unauthorized persons to access their accounts or devices.

If an account or device is compromised, unauthorized persons may potentially misuse functionality available to that account.

Users should promptly take appropriate security measures if they suspect unauthorized access.


20. Privacy

Use of Eye Friend is governed by the Eye Friend Privacy Policy and DeFiCall General Privacy Policy.

Those policies explain, among other matters:

  • how location information is protected;

  • encryption of Eye Friend location;

  • applicable location permissions;

  • authorization;

  • background location;

  • information DeFiCall may process;

  • data retention;

  • security; and

  • applicable user privacy rights.

Users should review the applicable privacy policies before enabling Eye Friend.


21. DeFiCall Server and Readable Location

Under the applicable Eye Friend architecture, DeFiCall servers do not receive or store users' Eye Friend location information in readable plaintext form.

DeFiCall infrastructure may process or store encrypted location information and limited technical information necessary to operate, secure, synchronize, and maintain the Service.

DeFiCall may also process account, authorization, security, diagnostic, and technical information as described in the Eye Friend Privacy Policy.


22. Requests From Authorities

DeFiCall will respond to valid and binding legal requests in accordance with applicable law.

DeFiCall cannot provide readable plaintext Eye Friend location from its servers where such location is not possessed by the server in readable plaintext form.

DeFiCall may nevertheless be legally required to provide other information that it actually possesses, such as certain account, technical, authorization, security, or encrypted information, where legally required.


23. Misuse and Enforcement

DeFiCall may investigate suspected misuse of Eye Friend.

Where reasonably necessary and permitted by applicable law, DeFiCall may:

  • issue warnings;

  • restrict location-sharing functionality;

  • revoke access to particular features;

  • temporarily suspend an account;

  • terminate access in serious or repeated cases; or

  • take other appropriate measures.

Such action may be taken where a user violates these Eye Friend Terms, the DeFiCall General Terms and Conditions, applicable policies, or applicable law.


24. False or Misleading Use

Users must not intentionally manipulate Eye Friend or provide false or misleading information for purposes of:

  • deceiving another user;

  • creating false safety concerns;

  • harassing another person;

  • committing fraud;

  • impersonating another person; or

  • facilitating unlawful conduct.

Attempts to manipulate the Service may result in enforcement action.


25. Service Availability

DeFiCall seeks to provide reliable Eye Friend functionality but does not guarantee uninterrupted availability.

Eye Friend may temporarily be unavailable because of:

  • maintenance;

  • software updates;

  • security updates;

  • infrastructure problems;

  • network outages;

  • operating-system changes;

  • regulatory requirements;

  • third-party service interruptions;

  • force majeure events; or

  • circumstances outside DeFiCall's reasonable control.

Users should maintain alternative communication and safety methods where appropriate.


26. Third-Party Dependencies

Eye Friend may depend on technologies and infrastructure supplied by independent third parties, including:

  • operating-system providers;

  • device manufacturers;

  • telecommunications networks;

  • internet providers;

  • GPS and location infrastructure;

  • mapping technology;

  • notification systems; and

  • cloud or technical infrastructure.

DeFiCall is not responsible for failures caused solely by independent systems outside its reasonable control.

Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.


27. Children's Use

Use of Eye Friend by minors is subject to the eligibility provisions of the DeFiCall General Terms and Conditions and applicable child-protection and privacy laws.

Where required, parental or legal guardian consent may be necessary.

Parents or guardians should appropriately supervise location-sharing functionality where required or appropriate.


28. International Availability

Eye Friend functionality may vary between jurisdictions because of:

  • local laws;

  • privacy requirements;

  • regulatory restrictions;

  • device functionality;

  • operating-system requirements;

  • telecommunications infrastructure; and

  • technical availability.

Availability of a feature in one country does not guarantee that identical functionality will be available in every country.


29. Limitation of Liability

To the maximum extent permitted by applicable law, DeFiCall is not responsible for losses caused solely by circumstances outside its reasonable control, including:

  • inaccurate device-generated location;

  • delayed location updates;

  • GPS failure;

  • internet or network failure;

  • device malfunction;

  • battery failure;

  • disabled permissions;

  • operating-system restrictions;

  • unauthorized conduct by an authorized recipient after information has been legitimately received;

  • independent third-party infrastructure failure; or

  • user misuse of Eye Friend.

DeFiCall does not guarantee that use of Eye Friend will prevent injury, loss, crime, disappearance, emergency situations, or other harmful events.

Nothing in these Terms excludes or limits liability, consumer protection, privacy rights, or other rights that cannot lawfully be excluded or limited.


30. User Responsibility

Users are responsible for using Eye Friend safely, responsibly, and lawfully.

This includes responsibility for:

  • granting location access intentionally;

  • authorizing only trusted persons;

  • reviewing authorized connections;

  • revoking unnecessary access;

  • protecting account credentials;

  • maintaining appropriate device permissions;

  • understanding location accuracy limitations;

  • respecting other users' privacy;

  • avoiding unauthorized tracking; and

  • complying with applicable laws.


31. Changes to Eye Friend

DeFiCall may modify, update, improve, restrict, replace, or discontinue aspects of Eye Friend where reasonably necessary for:

  • security;

  • privacy;

  • safety;

  • technical improvement;

  • legal compliance;

  • platform requirements; or

  • operational reasons.

Where required by applicable law, users will receive appropriate notice of material changes affecting their rights.


32. Changes to These Terms

DeFiCall may update these Eye Friend Terms from time to time to reflect changes in:

  • functionality;

  • encryption architecture;

  • privacy or security practices;

  • technology;

  • legal requirements;

  • platform requirements; or

  • operational practices.

The current version will display an updated “Last Updated” date.

Where required by applicable law, appropriate notice will be provided for material changes.


33. Relationship With General Terms

These Eye Friend Terms are Service-Specific Terms forming part of the broader DeFiCall Terms and Conditions.

They should be read together with:

DeFiCall General Terms and Conditions • DeFiCall General Privacy Policy • Eye Friend Privacy Policy

Where these Terms specifically govern Eye Friend, these feature-specific provisions apply to Eye Friend, subject to applicable law.


34. Contact Us

Questions, concerns, complaints, or reports regarding Eye Friend or these Terms may be submitted through the official support or contact information published within the DeFiCall application or on the official DeFiCall website.

DeFiCall will make reasonable efforts to review legitimate inquiries in accordance with applicable requirements.

1. Introduction

These SOS Terms and Conditions (“SOS Terms”) govern your access to and use of the DeFiCall SOS feature.

SOS is a privacy-focused safety communication feature designed to help users quickly alert trusted persons and securely share relevant location information during an emergency or safety-related situation.

SOS is designed around the principles of:

User Control • Trusted Helpers • Encrypted Location • Responsible Use

These SOS Terms supplement the DeFiCall General Terms and Conditions and should be read together with:

  • the DeFiCall General Terms and Conditions;

  • the DeFiCall General Privacy Policy; and

  • the SOS Privacy Policy.

By enabling, accessing, or using SOS, you agree to these SOS Terms.


2. Purpose of SOS

SOS is designed to provide users with a fast and privacy-conscious method of communicating safety-related information to trusted persons.

Depending on available functionality, device capabilities, permissions, and application version, SOS may enable users to:

  • activate an SOS alert;

  • notify selected Helpers;

  • securely share location information;

  • provide relevant location updates during an active SOS event;

  • communicate safety-related information; and

  • use other SOS functionality made available through DeFiCall.

SOS is primarily intended to facilitate communication between users and the trusted Helpers selected by those users.


3. Helper List

The Helper List is a user-controlled list of trusted persons selected by a user to receive SOS-related information.

Users decide whom to add to or remove from their Helper List.

Helpers may include:

  • family members;

  • friends;

  • colleagues; or

  • other trusted persons selected by the user.

DeFiCall does not independently choose a user's Helpers.

Users should add only people they know and trust.


4. User Authorization and Control

SOS operates through user-controlled authorization.

Users are responsible for:

  • deciding whether to use SOS;

  • selecting trusted Helpers;

  • managing their Helper List;

  • granting required device permissions;

  • reviewing authorized Helpers;

  • removing Helpers when appropriate;

  • protecting their account and device; and

  • using SOS only for lawful and legitimate purposes.

Merely having a DeFiCall account does not automatically authorize another user to access a user's SOS location.


5. Encrypted SOS Location

SOS location information is protected through encryption.

Under the applicable SOS architecture, DeFiCall servers do not receive or store users' SOS location information in readable plaintext form.

Location information transmitted to or stored within the applicable server infrastructure is maintained in encrypted form.

Accordingly:

  • SOS location information is protected through encryption;

  • DeFiCall servers do not receive readable plaintext SOS location;

  • location information is not intended to be publicly available;

  • ordinary DeFiCall users cannot access another user's SOS location merely by using DeFiCall; and

  • access to readable location information is restricted through the applicable authorized Helper mechanism.

Encryption is an important security measure, but no digital technology can guarantee absolute protection against every possible security threat.


6. No End-to-End Encryption Representation

Unless DeFiCall expressly states otherwise for a particular version or implementation of SOS, references to encrypted SOS location in these Terms should not be interpreted as a representation that the feature uses a particular end-to-end encryption architecture.

The applicable SOS implementation protects location information through encryption and is designed so that DeFiCall servers do not receive or store SOS location in readable plaintext form.

Technical security architecture may evolve as DeFiCall improves the Service.


7. Location Permissions

SOS requires appropriate device location permissions to provide location-based functionality.

Depending on the functionality, device, and operating system, users may be asked to permit:

  • approximate location;

  • precise location; and/or

  • background location where required for enabled SOS functionality.

Users may generally grant, deny, or withdraw these permissions through their device settings.

If required permissions are denied, restricted, or withdrawn, some SOS functionality may become unavailable or may not operate correctly.


8. Background Location

Certain SOS functionality may require location access while DeFiCall is not actively visible on the user's screen.

For example, during an active SOS event, continuing location updates may require background location access.

Where such access is required:

  • the applicable device permission will be requested;

  • users will be informed of its purpose;

  • background access will be used for functionality requiring it; and

  • users may manage or withdraw the permission through their device settings.

Disabling background location may interrupt or prevent continuous SOS location updates.

Location information generated through such functionality remains subject to the applicable SOS encryption protections.


9. SOS Activation

When a user intentionally activates SOS, DeFiCall systems may facilitate transmission of an SOS alert and encrypted location information to authorized Helpers.

Depending on available functionality, Helpers may receive:

  • notification that SOS has been activated;

  • available current location;

  • relevant location updates;

  • applicable timestamps; and

  • other safety-related information intentionally provided through SOS.

Activating SOS does not make the user's location publicly available.


10. Authorized Helpers

SOS location information is intended to be accessible only through the applicable authorization mechanism to Helpers selected by the user.

A Helper's authorization applies only within the scope of the functionality and permissions provided through SOS.

Authorization to receive another user's SOS information does not give a Helper ownership of that information or unrestricted rights to use it.


11. Responsibilities of Helpers

Helpers must handle SOS location and safety-related information responsibly.

Helpers must not use information received through SOS for:

  • stalking;

  • harassment;

  • intimidation;

  • unauthorized surveillance;

  • commercial exploitation;

  • unlawful disclosure;

  • blackmail;

  • discrimination;

  • threats; or

  • any other unlawful or abusive purpose.

Helpers are responsible for their own actions after legitimately receiving information through SOS.


12. Adding and Removing Helpers

Users are responsible for managing their Helper List.

Users should periodically review their Helpers and remove anyone who should no longer receive SOS information.

Where supported, removing a Helper prevents that person from receiving future SOS information through that authorization.

However, removal cannot necessarily erase information that an authorized Helper previously:

  • viewed;

  • remembered;

  • captured through a screenshot;

  • recorded;

  • independently stored; or

  • communicated outside DeFiCall.

Users should therefore select Helpers carefully.


13. Location Accuracy

SOS relies partly on location information generated by the user's device and related technologies.

Accuracy may be affected by:

  • GPS availability;

  • device capabilities;

  • buildings and physical surroundings;

  • internet connectivity;

  • mobile network conditions;

  • device sensors;

  • operating-system services;

  • location permission settings;

  • battery-saving settings; and

  • other technical or environmental factors.

Accordingly, DeFiCall does not guarantee that SOS location information will always be completely accurate, current, or continuously available.

Encryption protects confidentiality but does not determine the accuracy of location information generated by a device.


14. Live Location and Location Updates

Where SOS provides continuing or live location updates, the term “live” describes functionality designed to provide updated location information.

It does not guarantee instantaneous, uninterrupted, or perfectly real-time transmission.

Location updates may be delayed or interrupted because of:

  • network latency;

  • GPS limitations;

  • device settings;

  • operating-system restrictions;

  • background execution restrictions;

  • battery optimization;

  • connectivity problems; or

  • other technical circumstances.


15. Network and Device Dependencies

SOS functionality may depend on:

  • internet connectivity;

  • mobile or Wi-Fi networks;

  • GPS;

  • device hardware;

  • operating-system services;

  • application permissions;

  • background execution;

  • battery availability;

  • notification systems; and

  • other technical infrastructure.

SOS alerts or location updates may therefore be delayed, interrupted, inaccurate, or unavailable because of circumstances outside DeFiCall's reasonable control.


16. SOS Is Not an Emergency Response Service

DeFiCall SOS is a technology-based safety communication feature and is not an official emergency response service.

DeFiCall is not a:

  • police department;

  • ambulance service;

  • fire service;

  • hospital;

  • emergency dispatch center;

  • rescue organization; or

  • government emergency authority.

Unless expressly stated for a particular functionality, activating SOS does not automatically contact official emergency services.

SOS is primarily designed to facilitate communication between users and their selected Helpers.


17. Do Not Rely Exclusively on SOS

Users should not rely exclusively on DeFiCall SOS when professional emergency assistance is required.

Where there is an immediate threat to life, health, or physical safety, users should contact the appropriate local emergency service or authority whenever reasonably possible.

Users should not delay seeking professional emergency assistance solely because an SOS alert has been activated.


18. No Guarantee of Helper Response

Activation of SOS does not guarantee that a Helper will:

  • receive the alert immediately;

  • see the notification;

  • be available;

  • respond;

  • contact the user;

  • locate the user;

  • contact emergency services;

  • travel to the user's location; or

  • successfully provide assistance.

DeFiCall does not control the availability, decisions, actions, or response times of independently selected Helpers.


19. Location Does Not Confirm a User's Condition

Location information provided through SOS represents location information generated by the applicable device.

It does not necessarily establish:

  • whether the device is physically with the user;

  • the user's health or physical condition;

  • whether the user is safe;

  • whether the user requires professional assistance;

  • the precise circumstances surrounding the user; or

  • whether an emergency remains ongoing.

Helpers should use reasonable judgment when responding to an SOS alert.


20. Appropriate Use

SOS must be used responsibly and for legitimate safety-related purposes.

Users must not intentionally use SOS for:

  • false emergency alerts;

  • harassment;

  • stalking;

  • intimidation;

  • unauthorized tracking;

  • unlawful surveillance;

  • fraudulent activity;

  • malicious disruption;

  • deliberately misleading Helpers; or

  • any other unlawful or abusive purpose.

Users must not attempt to bypass the authorization, privacy, encryption, or security mechanisms associated with SOS.


21. Unauthorized Tracking and Surveillance

SOS must not be used as a mechanism for secretly or unlawfully tracking another person.

Users must not:

  • bypass authorization controls;

  • obtain location information through deception;

  • access another person's account without authorization;

  • circumvent privacy or security mechanisms;

  • use SOS for stalking;

  • conduct unlawful surveillance; or

  • otherwise violate another person's privacy or legal rights.

Misuse may result in restriction, suspension, or termination and may also expose the responsible user to legal consequences under applicable law.

Users are responsible for maintaining appropriate security over their:

  • DeFiCall account;

  • registered devices;

23. Privacy

Use of SOS is governed by the DeFiCall SOS Privacy Policy and the DeFiCall General Privacy Policy.

These policies explain, among other matters:

  • encryption of SOS location;

  • Helper authorization;

  • location permissions;

  • background location;

  • information DeFiCall may process;

  • technical and security information;

  • data retention;

  • data security; and

  • applicable privacy rights.

Users should review the applicable privacy policies before using SOS.


24. DeFiCall Server and Readable Location

Under the applicable SOS architecture, DeFiCall servers do not receive or store users' SOS location information in readable plaintext form.

DeFiCall infrastructure may process or store encrypted location information and limited technical information necessary to operate, secure, synchronize, and maintain SOS.

DeFiCall may also process account, Helper authorization, security, diagnostic, delivery, and technical information as described in the SOS Privacy Policy.


25. Requests From Authorities

DeFiCall will respond to valid and binding legal requests in accordance with applicable law.

Where DeFiCall servers do not possess SOS location information in readable plaintext form, DeFiCall may not possess readable plaintext SOS location within its server infrastructure to provide in response to such a request.

DeFiCall may nevertheless be legally required to provide information that it actually possesses, including certain:

  • account information;

  • Helper or authorization information;

  • technical records;

  • security information; or

  • encrypted information,

where required by applicable law.


26. Service Providers and Technical Infrastructure

SOS may depend on technologies and infrastructure supplied or supported by third parties, including:

  • operating-system providers;

  • device manufacturers;

  • telecommunications networks;

  • internet providers;

  • GPS and location infrastructure;

  • mapping technologies;

  • notification services;

  • cloud infrastructure; and

  • other technical service providers.

DeFiCall is not responsible for failures caused solely by independent third-party systems outside its reasonable control.

Nothing in these Terms limits rights or liabilities that cannot lawfully be excluded.


27. Service Availability

DeFiCall seeks to maintain reliable SOS functionality but does not guarantee uninterrupted availability.

SOS may temporarily become unavailable because of:

  • maintenance;

  • software updates;

  • security updates;

  • infrastructure problems;

  • network outages;

  • operating-system changes;

  • third-party service interruptions;

  • regulatory requirements;

  • force majeure events; or

  • circumstances outside DeFiCall's reasonable control.

Users should maintain alternative methods for contacting trusted persons and official emergency services.


28. Misuse and Enforcement

DeFiCall may investigate suspected misuse of SOS.

Where reasonably necessary and permitted by applicable law, DeFiCall may:

  • issue warnings;

  • restrict SOS functionality;

  • require additional security or account verification;

  • temporarily suspend access;

  • terminate access in serious or repeated cases; or

  • take other appropriate protective measures.

Enforcement may occur where users violate these SOS Terms, the DeFiCall General Terms and Conditions, applicable policies, or applicable law.


29. Children's Use

Use of SOS by minors is subject to the eligibility provisions of the DeFiCall General Terms and Conditions and applicable child-protection and privacy laws.

Where legally required, parental or legal guardian consent may be necessary.

Parents or guardians should appropriately supervise the use of safety and location-sharing functionality where required.


30. International Availability

SOS functionality may vary between countries or regions because of:

  • applicable laws;

  • privacy requirements;

  • regulatory restrictions;

  • telecommunications infrastructure;

  • GPS availability;

  • operating-system requirements;

  • device capabilities; and

  • technical availability.

Availability of SOS in one jurisdiction does not guarantee identical functionality in every jurisdiction.


31. Limitation of Liability

To the maximum extent permitted by applicable law, DeFiCall is not responsible for losses caused solely by circumstances outside its reasonable control, including:

  • inaccurate device-generated location;

  • delayed location updates;

  • GPS failure;

  • internet or network failure;

  • device malfunction;

  • battery failure;

  • disabled or restricted permissions;

  • operating-system limitations;

  • delayed or unavailable notifications;

  • Helper unavailability;

  • failure of an independent Helper to respond;

  • misuse of information by an authorized Helper after legitimate receipt; or

  • independent third-party infrastructure failure.

DeFiCall does not guarantee that SOS will prevent injury, loss, crime, disappearance, medical emergencies, accidents, or other harmful events.

DeFiCall also does not guarantee rescue, emergency intervention, successful delivery of every alert, or any particular outcome following activation of SOS.

Nothing in these SOS Terms excludes or limits any liability, consumer protection, privacy right, or other legal right that cannot lawfully be excluded or limited.


32. User Responsibility

Users are responsible for using SOS safely, responsibly, and lawfully.

This includes responsibility for:

  • activating SOS appropriately;

  • selecting trusted Helpers;

  • keeping the Helper List current;

  • maintaining required device permissions;

  • protecting account credentials;

  • maintaining device security;

  • understanding location accuracy and connectivity limitations;

  • avoiding false or abusive SOS alerts;

  • respecting other users' rights; and

  • contacting appropriate official emergency services when professional emergency assistance is required.


33. Changes to SOS

DeFiCall may modify, update, improve, restrict, replace, or discontinue aspects of SOS where reasonably necessary for:

  • safety;

  • security;

  • privacy;

  • technical improvement;

  • legal or regulatory compliance;

  • platform requirements; or

  • operational reasons.

Where required by applicable law, users will receive appropriate notice of material changes affecting their rights.


34. Changes to These SOS Terms

DeFiCall may update these SOS Terms to reflect changes in:

  • SOS functionality;

  • encryption architecture;

  • security practices;

  • location technology;

  • applicable laws;

  • platform requirements; or

  • operational practices.

1. Introduction

Welcome to DeFiCall, a global digital platform providing multiple products, features, and services through a unified ecosystem.

These General Terms and Conditions (“Terms”) govern your access to and use of the DeFiCall mobile applications, websites, web applications, platforms, products, features, and related services (collectively, the “Services”).

Throughout these Terms, “DeFiCall,” “we,” “us,” and “our” refer to the DeFiCall entity or entities responsible for providing the applicable Service, while “user,” “you,” and “your” refer to any person or organization accessing or using the Services.

By creating an account, accessing, or using DeFiCall, you agree to be bound by these Terms, our Privacy Policy, applicable Service-Specific Terms, and other policies or notices presented to you in connection with particular Services.

7. Prohibited Activities

  • impersonation or identity misuse;

  • unauthorized access to accounts, systems, or information;

  • assisting another person in violating these Terms.

DeFiCall may investigate suspected violations and take reasonable action, including restricting or terminating access where appropriate.


8. User Content and Information

Certain DeFiCall Services may allow users to create, upload, transmit, publish, store, share, sell, advertise, or otherwise make available content or information (“User Content”).

You retain ownership of intellectual property rights you lawfully hold in your User Content.

By submitting User Content through DeFiCall, you grant DeFiCall a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use that content only to the extent reasonably necessary to operate, provide, secure, improve, and support the applicable Services, subject to applicable law and our Privacy Policy.

You are responsible for ensuring that you have the rights and permissions necessary to provide your User Content.

You must not upload or distribute content that violates applicable law or the rights of another person.


9. Content Moderation and Enforcement

Where applicable, DeFiCall may use human review, automated systems, user reports, or other reasonable mechanisms to identify suspected violations of these Terms or applicable policies.

Depending on the circumstances, DeFiCall may:

Depending on the Service, payments may be processed through DeFiCall-supported payment systems or authorized third-party payment providers.

Additional terms may apply to specific payment, wallet, marketplace, subscription, or transaction-related Services.


11. Digital Services and Subscriptions

Certain digital features may be offered through paid subscriptions, recurring plans, one-time purchases, or other payment arrangements.

Where required by the platform through which a purchase is made, payments and subscription management may be governed by the rules and billing systems of that platform, including applicable app marketplace policies.

The price, billing period, renewal conditions, cancellation options, and other material terms will be communicated before or in connection with the applicable purchase.

Cancellation of a subscription generally prevents future renewals but does not automatically entitle the user to a refund for a completed billing period unless required by applicable law or the applicable refund policy.


12. Wallet and Payment Services

Where DeFiCall provides wallet, payment, balance, settlement, withdrawal, or related functionality, additional Wallet and Payment Terms may apply.

Availability of such functionality may depend on:

  • jurisdiction;

  • regulatory requirements;

  • identity verification;

  • transaction limits;

  • payment providers;

  • supported currencies;

  • risk and security controls; and

  • applicable laws.

Balances, credits, rewards, promotional values, or other amounts may have different characteristics and restrictions depending on the applicable Service.

Users should review the relevant Service-Specific Terms before using wallet or payment functionality.

DeFiCall may integrate with or provide access to products and services supplied by independent third parties, including merchants, payment providers, travel providers, healthcare providers, educational providers, delivery companies, service professionals, advertisers, API providers, or other external organizations.

Unless expressly stated otherwise, DeFiCall is not an emergency response authority, police service, ambulance service, fire service, rescue organization, or substitute for official emergency services.

Emergency-related functionality may depend on device functionality, internet or mobile connectivity, location availability, permissions, third-party systems, and other factors.

Additional conditions and limitations applicable to emergency-related features will be stated in the relevant Service-Specific Terms.


17. Health, Educational and Professional Information

Certain DeFiCall Services may provide access to healthcare professionals, educators, consultants, experts, service providers, automated tools, informational materials, or other professional resources.

Unless expressly stated otherwise, DeFiCall itself does not guarantee the accuracy, suitability, professional qualifications, outcome, or effectiveness of advice or services provided by independent third parties.

Certain Services may contain additional disclaimers or eligibility requirements appropriate to their nature.

Users should seek appropriate qualified professional assistance where circumstances require it.


18. Intellectual Property

Except for User Content and third-party materials, the DeFiCall platform and its associated software, design, branding, logos, trademarks, interfaces, databases, text, graphics, technology, and other proprietary materials are owned by or licensed to DeFiCall and are protected by applicable intellectual property laws.

Except as permitted by law or expressly authorized by DeFiCall, users may not:

  • copy;

  • reproduce;

  • distribute;

  • sell;

  • license;

  • modify;

  • reverse engineer;

  • create unauthorized derivative works from; or

  • commercially exploit

DeFiCall proprietary materials.

No ownership rights in DeFiCall intellectual property are transferred to users merely through use of the Services.

We aim to provide reliable Services, but we do not guarantee that every Service will be available continuously, uninterrupted, error-free, or in every country, device, network, or operating environment.

Services may occasionally be unavailable due to:

23. Suspension and Termination

DeFiCall may restrict, suspend, or terminate access to an account or Service where reasonably necessary, including where:

  • these Terms are materially or repeatedly violated;

  • fraudulent or unlawful activity is suspected;

  • security risks exist;

  • required verification cannot be completed;

  • the account creates material risk to users or the platform;

  • required by law or regulatory authority; or

  • continued access would reasonably threaten the security or integrity of the Services.

Where appropriate and legally required, DeFiCall may provide notice or an opportunity to appeal.

Users may stop using DeFiCall and may request account deletion subject to applicable procedures and legal retention requirements.


24. Disclaimer of Warranties

To the maximum extent permitted by applicable law, DeFiCall Services are provided on an “as available” basis.

DeFiCall does not guarantee that:

  • Services will always be uninterrupted or error-free;

  • every feature will be available in every jurisdiction;

  • third-party services will always operate correctly;

  • all information supplied by independent users or third parties will be accurate; or

  • use of a Service will produce a particular commercial, financial, professional, health, educational, or other outcome.

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.


25. Limitation of Liability

To the maximum extent permitted by applicable law, DeFiCall will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Services where such liability may lawfully be limited.

This may include losses resulting from:

  • unauthorized third-party conduct;

  • interruption of Services;

  • independent third-party services;

  • user-generated information;

  • device or network failures; or

  • circumstances outside DeFiCall's reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability where applicable law provides mandatory consumer protections.

Any additional limitations applicable to a specific Service will be stated in the relevant Service-Specific Terms.


26. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, liabilities, claims, damages, or reasonable costs arising directly from:

  • your material violation of these Terms;

  • your unlawful use of the Services;

  • your infringement of another person's rights; or

  • User Content provided by you that violates applicable law or third-party rights.

This provision does not require users to indemnify DeFiCall for matters caused by DeFiCall's own unlawful conduct where such liability cannot legally be transferred.

  • in-app notifications;

  • push notifications;

Certain Services may therefore be unavailable, restricted, or modified in particular jurisdictions.


30. Governing Law and Dispute Resolution

These Terms will be governed by the laws applicable to the DeFiCall entity responsible for providing the relevant Service, subject to mandatory consumer-protection or other rights available to users under applicable law.

Before commencing formal proceedings, users and DeFiCall are encouraged, where appropriate, to attempt to resolve disputes through good-faith communication.

Additional jurisdiction, dispute-resolution, arbitration, mediation, or court provisions may be specified for particular Services or regions where appropriate and legally enforceable.

Nothing in these Terms removes any mandatory legal right or remedy available to a user under applicable law.


31. Changes to These Terms

DeFiCall may update these Terms periodically to reflect changes in:

  • Services and features;

  • technologies;

  • business operations;

  • security requirements;

  • applicable laws or regulations; or

  • other legitimate operational requirements.

The revised Terms will display an updated “Last Updated” date.

Where required by applicable law, users will receive reasonable notice of material changes.

Continued use of the Services after updated Terms become effective constitutes acceptance to the extent permitted by applicable law. Where affirmative consent is legally required, DeFiCall will request it separately.


32. Severability

If any provision of these Terms is determined by a competent authority to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, where legally permissible.

The remaining provisions will continue in effect.


33. No Waiver

Failure by DeFiCall to immediately enforce any provision of these Terms does not constitute a waiver of that provision or any other legal right.

Any waiver must be made in accordance with applicable law.


34. Assignment

Users may not transfer or assign their rights or obligations under these Terms without DeFiCall's authorization where such restriction is permitted by law.

DeFiCall may assign or transfer its rights and obligations in connection with a corporate restructuring, merger, acquisition, sale, reorganization, or transfer of the relevant business, subject to applicable law and user rights.


35. Entire Agreement

These General Terms, together with the Privacy Policy, applicable Service-Specific Terms, and other policies or conditions expressly incorporated into them, constitute the agreement governing your use of the applicable DeFiCall Services.
